The following governs your use of all the web pages hosted by Remedy Way, a California Company, and any affiliates or partners owned or managed by Remedy Way, (collectively referred to as “Remedy Way”, “we” or the “Site”). By accessing or using the Site, you expressly agree and consent to the following terms and conditions. If you do not accept the following terms and conditions, then do not use this Site.

WHO DOES THIS APPLY TO?

The following terms and conditions apply to all users or end-users of our bill pay plan, referred to as "members". By using our bill pay plan, members agree to these terms and conditions.

It is the responsibility of the member to carefully read and understand these terms and conditions before using the bill pay plan. If the member does not agree with these terms and conditions, they should not use the bill pay plan.

Membership in the bill pay plan is not transferable or assignable. The member may not share their membership with any other person or entity.

WHAT IS YOUR OBLIGATION AS A USER?

By using our bill pay plan, you acknowledge and agree that you are 18 years of age or older. If you are not 18 years of age or older, you may not use the bill pay plan. You acknowledge that Remedy Way owns your account and that you have no ownership rights to your account. You agree to abide by the following rules:

  • As a user, you agree to provide accurate and complete information when applying for the bill pay plan.

  • You understand that providing false or fraudulent information may result in the termination of your membership in the plan.

  • You agree to keep your login credentials confidential and not share them with anyone.

  • You are responsible for any activity that occurs under your account, including any unauthorized use of your login credentials.

  • You agree to use the bill pay plan for its intended purpose only and not for any unlawful or unauthorized purposes.

  • You also agree not to interfere with or disrupt the operation of the bill pay plan or the servers or networks used to make the plan available.

  • You agree to notify Remedy Way immediately of any unauthorized use of your membership and password.

  • You agree not to present Remedy Way Site Content (or permit Site Content to be presented) in such a way that it appears to be available from a third-party Web site.

  • You agree to not delete or revise any material posted by others.

  • You agree to not breach or attempt to breach the security measures incorporated in the Site or access data not intended for your use.

  • You agree to not log into a server or account which you are not authorized to use.

  • You agree that you will not use the Site to advertise or offer to sell or buy any goods or services.

  • You agree to not use the Site for any unlawful purpose or in any manner that would violate international, federal, or local laws or regulations.

  • You agree not to interfere with the service to any User, host, or network.

  • You agree not to modify, reverse engineer, decompile, translate or disassemble any portion of the Site.

  • You agree to access the Site only through the interfaces provided by the Site or by navigating to https:// Remedy-Way.com/ using a web browser.

  • You agree to not use the software, devices, script robots, other means or processes to access, “scrape,” “crawl,” or “spider” any web pages or other services contained in or on the Site.

WHEN YOU WANT TO UPLOAD/POST OR DISTRIBUTE FORMS AND DOCUMENTS

  • When you want to upload, post or distribute forms and documents through our bill pay plan, you agree to the following:

  • You certify that you have the legal right to post or distribute the forms and documents, and that they do not violate any laws, regulations, or third-party rights.

  • You grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, distribute, publish, and process the forms and documents for the purpose of providing the bill pay plan to you.

  • You agree to indemnify, defend, and hold us harmless from any claims, damages, or expenses arising from your use of the bill pay plan or the forms and documents you upload or distribute.

  • You acknowledge that we have the right to remove any forms and documents that we deem inappropriate or in violation of these terms and conditions.

  • You agree that any forms and documents you upload or distribute through the bill pay plan may be subject to review by us to ensure compliance with these terms and conditions and any applicable laws or regulations.

BILL PAY PLANS DO NOT PROVIDE LEGAL ADVICE

The bill pay plan is designed to assist members in paying their bills during times of financial hardship. However, we do not provide legal advice or services. Any information provided through the bill pay plan is for informational purposes only and should not be construed as legal advice.

 

You are solely responsible for making your own legal decisions and should consult with a licensed attorney for any legal advice or services. We make no representations or warranties, express or implied, regarding the accuracy, reliability, or completeness of any information provided through the bill pay plan.

By using the bill pay plan, you acknowledge and agree that we are not providing legal advice or services and that you will not rely on any information provided through the bill pay plan as a substitute for legal advice or services from a licensed attorney.

PAYMENTS

The Remedy Way—Bill Pay Relief plan offers monthly and annual payment options to suite the needs of our members. Payment for the bill pay plan will be made in full and prior to the 30 day subscription period.

​

We only accept autopay for online payments, which will automatically renew your membership at the end of each billing cycle unless you cancel the membership in accordance with the cancellation policy outlined below.

​

Prices for the Bill Pay Protection plan are subject to change at any time. We will provide notice of any price changes to members in advance of the next subscription period.

​

By becoming a member of the Bill Pay Protection plan, you agree to pay the subscription fee for the chosen subscription period and any applicable taxes. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms.

​

You may cancel your subscription at any time, but we do not provide refunds or credits for any partial membership periods. See the cancellation policy section below for more information.

​

REFUND AND EXCHANGE POLICY

Bill Pay Protection plan does not offer refunds or exchanges for any subscription periods or services rendered. All subscription fees are non-refundable and non-transferable.

​

In the event that you cancel your subscription, you will continue to have access to the bill pay plan for the remainder of the subscription period. After the subscription period ends, you will not have access to the bill pay plan unless you renew your subscription.

​

If you believe that you were charged in error or have questions about your subscription, please contact our customer support team for assistance.

We reserve the right to modify the refund and exchange policy at any time. Any changes to this policy will be communicated to members in advance of the next subscription period.

SERVICES RENDERED 

The Bill Pay Relief plan provides bill payment assistance to eligible members. However, eligibility does not guarantee that all bills will be paid. Payments provided by the plan may be paid full or may be partial payments, also payment assistance is subject to availability of funds and other factors.

​

While we strive to pay bills in full, sometimes we may need to make partial payments to ensure that as many bills as possible can be covered. The member must have been a member for at least 90 days prior to applying for bill pay assistance to qualify for review.

​

We want to emphasize that the bill pay plan is not a loan service and does not accumulate interest or fees. Payments made by the plan are strictly for bill payment assistance and are not intended to be a source of income or financial gain.

​

We make every effort to provide payment assistance to eligible members as quickly and efficiently as possible. However, we cannot guarantee that all bills will be paid in full or on time.

​

Additionally, the Bill Pay Protection plan reserves the right to refuse payment assistance to any member who violates our terms and conditions or engages in fraudulent activity:

We may refuse to process any bills that we believe may violate the law or the terms of Remedy Way. Your bill pay may be denied if you (i) the bill is deemed to be unlawful domestic or international gambling web sites, or at payment processors supporting unlawful gambling web sites, or to purchase illegal goods or services; (ii) excessively exceeds reasonable submission limitations described in the terms of Remedy Way, or (iii) we otherwise have reason to believe the bill is fraudulent or not in compliance with the terms of Remedy Way.

We strive to provide the best possible service to our members and are committed to addressing any concerns or issues in a timely manner. If you have any questions or concerns about our services, please contact our customer support team for assistance.

BILL PAYMENT DISTRIBUTION

By using the Bill Pay Relief plan, the member authorizes the plan managers to contact the billing companies and service providers directly to make payments on the member's behalf.

​

The plan managers will use the information provided by the member in the application to make the payments, and the member agrees to provide accurate and complete information.

​

The plan managers will make payments in accordance with the terms of the Bill Pay Relief plan and will not be responsible for any late fees, penalties, or interest charges resulting from the member's failure to provide accurate or complete information.

​

The member acknowledges that the plan managers are not responsible for any errors or omissions made by the billing companies or service providers, and that any disputes regarding billing must be resolved directly with the billing companies or service providers.

​

We do not offer cash distributions to the member to pay their bills. Any payments made by our plan managers will be made directly to the billing entity or vendor authorized by the member.

​

Any overpayments made on behalf of the member will be credited towards future bill payments. It is the responsibility of the member to ensure accurate billing information is provided to our plan managers to avoid overpayments or delays in payments.

​

CANCELLATION POLICY

Members may cancel their subscription to the Bill Pay Relief plan at any time by contacting our customer service team. The cancellation will become effective at the end of the current billing cycle. Refunds will not be issued for any payments already made.

​

If a member cancels their subscription before the end of the current billing cycle, they will continue to have access to the plan until the end of the cycle. No pro-rated refunds will be issued for early cancellations.

​

We reserve the right to terminate a member's subscription at any time for any reason, including violation of these terms and conditions. In such cases, we will provide notice to the member and issue a prorated refund for any unused portion of the subscription.

​

Please note that cancellation of the Bill Pay Relief plan will not cancel any outstanding payments that have already been scheduled or processed on behalf of the member. Members are responsible for ensuring that all outstanding bills are paid in full after cancellation of the plan.

REPRESENTATIONS OR WARRANTIES

Remedy Way makes no representations or warranties with regard to the Site Content (including, without limitation, third party material) or communications from Customer Service representatives, all of which are provided on an “as is” and/or “as available” basis. Remedy Way hereby disclaims all warranties, express or implied, including without limitation the implied warranties of merchantability and fitness for a particular purpose.

By using our bill pay plan, you represent and warrant that:

  • You are at least 18 years old or above the legal age in your jurisdiction, and you have the right, power, and authority to enter into and comply with these terms and conditions.

  • All information provided to us by you or on your behalf is true, accurate, and complete, and you will promptly notify us of any changes or updates to such information.

  • You acknowledge and agree that the plan managers are not responsible for any errors or inaccuracies in the information you provide or for any resulting consequences.

  • You acknowledge and agree that the plan managers do not make any representations or warranties regarding the availability, reliability, accuracy, or completeness of the bill payment pr, and you use the plan at your own risk.

  • You acknowledge and agree that the plan managers are not responsible for any loss, damage, or liability arising from any action or inaction by you or any third party, including but not limited to any failure to pay your bills, any disputes with your billing companies or any errors in your billing statements.

  • You acknowledge and agree that the plan managers have the right to investigate any potential fraudulent or abusive activity and may take any appropriate legal action against you, including but not limited to terminating your membership and reporting you to the appropriate authorities.

  • You acknowledge and agree that the plan managers reserve the right to modify, suspend or terminate the bill payment plan at any time, with or without notice to you.

  • You acknowledge and agree that the plan managers may, in their sole discretion, modify these terms and conditions at any time by posting the modified terms and conditions on our website, and your continued use of the plan after such modification shall constitute your acceptance of the modified terms and conditions.

  • You acknowledge and agree that the plan managers may terminate your membership at any time for any reason, including but not limited to any breach of these terms and conditions or any failure to pay the membership fee. In the event of such termination, you will not be entitled to any refund or exchange of your membership fee.

LIABILITY DISCLAIMER:

The Bill Pay Relief plan provides services and resources to its members in good faith and with the intention to assist them in times of hardship. However, we cannot guarantee the availability or accuracy of any of the services or resources provided, or the outcome of any bill payments made on behalf of members.

​

By using our services, you agree that we shall not be liable for any damages or losses resulting from the use or inability to use our services or resources, including but not limited to, direct, indirect, incidental, punitive, and consequential damages. This includes damages or losses resulting from errors, delays, or interruptions in the operation of our services, as well as from any unauthorized access to or alteration of your personal information.

Furthermore, by using our services, you acknowledge and accept that we are not responsible for the acts or omissions of any third-party service providers, including but not limited to, the providers of the billing and payment services we utilize to make payments on your behalf.

​

In any event, our liability to you for any cause whatsoever, and regardless of the form of the action, shall be limited to the amount paid by you, if any, for our services during the preceding twelve (12) months.

​

You acknowledge and agree that the limitations and exclusions of liability and disclaimers of warranties set forth in this Agreement are fundamental elements of the basis of the bargain between us and you, and that we would not be able to provide the services to you without such limitations and exclusions.

​

BINDING ARBITRATION.

THIS SECTION PROVIDES FOR RESOLUTION OF DISPUTES THROUGH FINAL AND BINDING ARBITRATION BEFORE A NEUTRAL ARBITRATOR INSTEAD OF IN A COURT BY A JUDGE OR JURY. If any dispute arises, you must first contact Remedy Way by email at info@remedy-way.com, so that we can endeavor to resolve the issue. In the event that we cannot resolve a dispute within sixty (60) days of notification, then all disputes arising under or relating to this Agreement shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules and Supplementary Procedures for Consumer-Related Disputes (“Supplementary Procedures”) as it may be amended from time to time.

MONTHLY & YEARLY SUBSCRIPTION

Our bill pay plan offers monthly and annually subscription plans that automatically renew each month or after 12 months of membership. By subscribing to our monthly or annual plan, you authorize us to charge your designated payment method on a recurring basis until you cancel your subscription.

​

Monthly Plan Subscription charges will be applied on a monthly basis, on or around the same date that you signed up for the subscription. You are responsible for ensuring that your payment information is accurate and up to date.

​

Annually Plan Subscription charges will be applied on a yearly basis, on or around the same date that you signed up for the subscription 12 months prior. You are responsible for ensuring that your payment information is accurate and up to date.

 

You may cancel your monthly or annual subscription plan at any time by logging into your account and cancelling the subscription. If you cancel your subscription, you will continue to have access to the bill pay plan until the end of your current billing cycle or at the end of 12 months of membership for the annual plan.

We reserve the right to modify or discontinue our monthly subscription plans at any time without notice to you. In the event of any changes to our subscription plans, we will notify you in advance and provide you with the option to cancel your subscription.

​

We do not provide refunds for cancelled monthly subscriptions or unused portions of monthly subscriptions.

​

PRICING CHANGES.

Effective: November 25, 2023, Remedy Way established prices of the following products: (1 Annual Bill Payment, 2 Annual Bill Payments, or 3 Annual Bill Payments)

 

Monthly Subscription Plan: (Allowance: 1 Relief Payment Annually)  

Monthly Subscription Plan: Allowance: 2 Relief Payment Annually) 

Monthly Subscription Plan: (Allowance: 3 Relief Payment Annually)

We reserve the right to modify the pricing of our bill pay plan at any time without prior notice. Any changes in pricing will be effective immediately for new members who sign up after the change is implemented or upon the next billing cycle.

​

For existing members, the new pricing will be effective upon the next renewal of their membership. We will make reasonable efforts to notify our members of any pricing changes via email or by posting a notice on our website.

​

Your continued use of the bill pay plan after the pricing changes will constitute your acceptance of the new pricing. If you do not agree with the new pricing, you may cancel your subscription plan in accordance with our cancellation policy.

​

LIMITATIONS BY SUBSCRIPTION PLAN:

Our Monthly and Yearly Plans offer the convenience of Bill Pay Relief with different submission limits. Depending on the plan you choose, you will have the flexibility to submit bill payment requests 1, 2, or 3 times within the specified period. This means that during the duration of your plan, you can rely on our assistance to cover your bills on up to the designated number of occasions.

​

We understand that circumstances can vary, and members may have a need for additional bill payment requests beyond the allowance included in their plan. If a member exceeds the designated request allowance within their current plan, we offer the flexibility to upgrade to a higher plan that better suits their needs.

​

By upgrading to a higher plan, members can continue to receive the benefits of our Bill Pay Relief plan and have a greater number of bill payment requests available to them.

​

If a member opts not to upgrade to a higher plan they will have to wait until 12 months of continuous membership. At this time, the member will be automatically provided a new set of bill payment relief requests, ensuring they can continue receiving financial assistance when needed.

GENERAL TERMS:

Entire Agreement: These Terms and Conditions, together with any additional policies, guidelines, or rules posted on our website, constitute the entire agreement between you and us with respect to the subject matter hereof and supersedes any prior or contemporaneous understandings, representations, or agreements, whether written or oral.

​

Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of California, without giving effect to any principles of conflicts of law.

​

Waiver: Our failure to enforce any right or provision of these Terms and Conditions shall not be deemed a waiver of such right or provision.

​

Severability: If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

​

Assignment: These Terms and Conditions are binding upon and shall inure to the benefit of you and us and our respective successors and assigns. You may not assign these Terms and Conditions without our prior written consent.

​

Amendments: We reserve the right to modify or amend these Terms and Conditions at any time. If we make material changes to these Terms and Conditions, we will notify you by email or by posting a notice on our website. Your continued use of our services following any such changes shall constitute your acceptance of such changes.
